1.0 OVERVIEW
Heal Coins, addressed as digital coins or the digital
currency for healthcare and other related community assistance transactions,
are purchased, saved, and used from its digital banking system, addressed as
the Heal Cash Wallet.
Heal Coins is part and parcel of the mother system, CHUDATS, hosted through the domain name
CHUDATS.NET and also related through the domain names healcash.net and healnotes.com.
Heal Coins, abbreviated as HC, are introduced as a generational incentive for
revolutionising the healthcare industry in terms of financing, technology, and
patient care.
The HC is principally applied within the entire global
application of CHUDATS, including the mobile application “Heal the Sick,” and guided through its principal domain name,
HEALCOINS.NET. HC inclusively connects to all its sub-domain names in whatever
forms provided, if such are officially preceded by xx.healcoins.net, wherein
“xx” represents the sub-domain name given and attached to the main domain
HEALCOINS.NET. Throughout the web portal and other applications of CHUDATS, the
terms “we," "us,” and “our” refer to CHUDATS and/or any of its
sub-domain links and/or its derivative digital HC currency. HEALCOINS.NET
offers this e-service opportunity website to you, the user (which includes
everyone: health structures or units, patients, funders, donors, and
supporters), conditioned upon your acceptance of all terms, conditions,
policies, and notices stated herein.
1.1 Acceptance
of Terms
Heal Coins offers a dynamic opportunity for everyone,
including individuals and organizations, to be able to purchase and save the
new digital currency against healthcare-related payments within CHUDATS and more, as well as for making and
tracking donations to the sick, healthcare facility projects, and other
approved projects to heal the community. The current Terms and Conditions or
user agreement is meant to elaborate on the Terms of Service between you, the
user, and us, CHUDATS. Please read these Terms of
Service carefully before accessing or using our offers. By accessing or using
any part of us, you agree to be bound by these Terms of Service. If you do not agree to all the terms and
conditions of this agreement, then you may not purchase our heal coins, use our
database software, web portal, or mobile application or make use of any of the
provided services. If these Terms of
Service are considered an offer, acceptance is expressly limited to these
Terms of Service.
Any new features or tools that are added to us shall
also be subject to these Terms of Service. We reserve the right to update,
change, or replace any part of these Terms of Service by posting updates and/or
changes to our web portals (chudats.net, healcoins.net), mobile application,
and database software. You have the sole responsibility to regularly check on
the updates before usage. It is your responsibility to check this page
periodically for changes, and your continuous usage constitutes acceptance of
those updates.
1.2 Intellectual Property
CHUDATS and all of its derivative products and services expressly acclaimed within its user agreements are under a licensed patent invention with PV No. 1202200504 of 01/12/2022 by Dr. Kelly NGYAH, published in the official bulletin BOPI No. 03BR/2024 and protected by the African Intellectual Property Organization (AIPO) or (OAPI). Both hardware and software products and services (No.21440), including web portals, mobile applications, and digital currency incentives, which are Heal Coins, and Heal Notes, together addressed as Heal Cash, are granted exclusive exploitation rights to the non-governmental organization Modern Advocacy Humanitarian Social and Rehabilitation Association (MAHSRA) and its incorporation, MAHSRA INCORPORATE COMPANY LTD.
Unless otherwise indicated by us, all intellectual property rights and any content provided in connection with the healcoins.net site or the services are the property of the inventor. By using material or content delivered on this site, you expressly accept that such is made for your personal, lawful, non-commercial, and purposeful use of the products and/or services set forth in this user agreement.
Any further use of material or content on this site is strictly forbidden; therefore, by using this site, you agree not to infringe or enable anyone else to infringe on the intellectual property rights. Without any limitation to copying, reproduction, display, and/or distribution of content and material on this site for any commercial purpose, it is strongly forbidden and prohibited to proceed with any infringing attitudes unless through clearly expressed and written consent from the inventor and/or the institutions holding the exploitation rights.
SECTION 1 – HEAL COINS USAGE TERMS
By agreeing to these Terms and Conditions, you represent that you are at
least the age of majority in your state, province, or country of residence, or
that you are at the age of majority in your region, province, or country of
residence, and you have given us your consent to allow any of your minor
dependents to use this site and the rest of our products.
You may not use our services for any illegal or unauthorized purpose,
nor may you, in the use of our services, violate any laws in your jurisdiction
(including but not limited to copyright laws).
You must not
transmit any worms, viruses, or any code of a destructive nature.
A breach or
violation of any of the Terms will result in the immediate termination of your
services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse access to our CHUDATS services to anyone for any reason at any time.
You understand that your content (not including credit
card information) may be transferred unencrypted and involve (a) transmissions
over various networks and (b) changes to conform to and adapt to the technical
requirements of connecting networks or devices. Credit card and other mobile
financial transaction information is always encrypted during transfers over
networks.
You agree not to reproduce, duplicate, copy, sell,
resell, or exploit any portion of the Service, use of the Service, or access to
the Service, or any contact on CHUDATS.NET and HEALCOINS.NET through which the
service is provided, without express written permission by us.
SECTION 3 -
ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not fully responsible if the information made
available on healcoins.net is not accurate, complete, or current. The material
on this site is provided for technical and general information with respect to
CHUDATS, healcoins.net, and “Heal the Sick” mobile app service needs. All users
are advised to provide the most accurate identity information in a consistent
manner in order to avoid system data duplication and error processing. Our
services may retain historical information for referential purposes. However,
we reserve the right to modify the contents of this site at any time, but we
have no obligation to update any information on CHUDATS platforms. You agree
that it is your responsibility to monitor the changes we make.
SECTION 4 – HEAL COINS ACQUISITION AND
USAGE MODALITIES
Heal Coins
are issued in various digital coin faces and numeric denominations which can be
obtained through online purchases using various payment methods, gifts or
rewards for users, and donations made through CHUDATS.
4.1 Saving
and Using Heal Coins
Through
diverse methods of acquiring HC, each system user, when logged in is
automatically given a Heal Cash Wallet (HCW) that acts as a savings online bank
account for the user. The HCW is a very personalized and encrypted user method
for handling HC transactions for all users through specific global user
identities.
ü
As an identified patient
within CHUDATS, the HCW is linked to the unique global identity of the patient,
through which other users can directly transfer or purchase HC into the
patient’s HCW.
ü
As an identified physician
or doctor/consultant within the system, the HCW provides an HC reception
account that serves to receive and refund payments for services rendered to
other system users.
ü
As a health unit or
identified health facility using CHUDATS, the HCW provides a digital currency
banking account that collects HC donation amounts from various sources,
processes HC transfers for the benefit of concerned patients, and handles other
medical bill settlement processes within the system.
ü
As a benefiting community
organization or project, the HCW provides an HC reception account that, upon
the consent of the benefiting structure or program, can receive donations in
HC.
ü
Users with HCW can also
receive, save, transfer, or make payments within the system or to one another
in the form of donations, health bill settlements, service exchanges, and more.
SECTION 5 - MODIFICATIONS TO HEAL
COINS SERVICES, FEES AND PRICING
CHUDATS, including its derivate applications such as
Heal Coins, are freely offered to users other than the subscribing health
facilities, which have specific modalities and conditions for integrating the
system for their structural and institutional management.
As a user and holder of a verified CHUDATS account,
you are entitled to a free HCW through which you can receive HC from various
sources and use it. Transferring HC from one user account to the other is done
free of charge; however, making payments for services or donations for causes
entails minimal transaction handling fees or charges that are fixed by us and
the benefiting party.
We reserve the right to include or change fees for HCW
accounts, transactions, usages, or the principles of pricing from time to time
following these Terms and Conditions.
In the case of defaulting users who may be in breach
of one or more of the terms of usage, we reserve the right to suspend and/or
freeze the user accounts until such a breach is satisfactorily resolved.
In case of unforeseen irregularities, we reserve the
right at any time to modify or discontinue the Service (or any part or content
thereof) without notice at any time.
SECTION 6 -
OPTIONAL TOOLS
We may provide you with access to third-party tools
over which we do not monitor or have any controls or input.
You acknowledge and agree that we provide access to
such tools “as is” and “as available” without any warranties, representations,
or conditions of any kind and any endorsement. We shall have no liability
whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through our
platform is entirely at your own risk and discretion, and you should ensure
that you are familiar with and approve of the terms on which tools are provided
by the relevant third-party provider(s).
We may also, in the future, offer new services and/or
features through CHUDATS products (including the release of new tools and
resources). Such new features and/or services shall also be subject to these Terms and Conditions as well as the
User Agreement of CHUDATS.
SECTION 7 -
THIRD-PARTY LINKS
Certain content, products, and services available via
our Heal Coins and other CHUDATS services may include materials from third
parties.
Third-party links on our web portals (healcoins.net)
and mobile application (Heal the Sick) may direct you to third-party websites
that are not affiliated with us. We are not responsible for examining or
evaluating the content or accuracy, and we do not warrant and will not have any
liability or responsibility for any third-party materials or websites, or any
other materials, products, or services of third parties.
We are not liable for any harm or damages related to
the purchase or use of goods, services, resources, content, or any other
transactions made in connection with any third-party websites. Please review
carefully the third party's policies and practices and make sure you understand
them before you engage in any transaction. Complaints, claims, concerns, or
questions regarding third-party products should be directed to the third party.
SECTION 8 -
PERSONAL INFORMATION
Your submission of personal information through
CHUDATS (including the database software, the web portals, and the mobile
application) is governed by our Privacy Policy.
SECTION 9 -
PROHIBITED USES
In addition to other prohibitions as outlined in these
Terms and Conditions, you are prohibited from using this site, healcoins.net,
and its corresponding sub-domains and affiliations or their contents for any
unlawful purposes, as well as concerning the Prohibited Uses on the CHUDATS.NET web portal.
SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY AND
REPRESENTATION
10.1 Disclaimer
of Warranties
We do not guarantee, represent, or warrant that your
use of our services will be uninterrupted, timely, secure, or error-free.
We do not warrant that the results that may be
obtained from the use of our services and products will be accurate or
reliable.
You, the user, agree that from time to time, as the
need arises, we may hold our services for indefinite periods due to repairs and
other irregularities, or, at worst, cancel the service at any time, without
notice to you. However, we will do well to inform our users in time if a formal
decision to cancel any or all of our services is reached, but we cannot
guarantee that every one of our site’s users will be able to access the notice
in their own time.
You expressly agree that your use of, or inability to
use, our services is at your sole risk. Our Heal Coins offers and other CHUDATS
products and services and other third-party services delivered to you through
healcoins.net and the “Heal the Sick” mobile app, and its official sub-domains
(except as expressly stated by us), are provided 'as is' and 'as available' for
your use, without any representation, warranties, or conditions of any kind,
either express or implied, including all implied warranties or conditions of
infallibility, regularity, perfection, durability, title, and non-infringement.
10.2
Limitation of Liability
Outside our traditional agreements or MOU entered with
our client health structures and medical consultants, in no case shall Heal
Coins and other CHUDATS Services, our directors, officers, employees,
affiliates, agents, contractors, interns, suppliers, service providers, or
licensors be liable for any injury, loss, claim, or any direct, indirect,
incidental, punitive, special, or consequential damages of any kind, including,
without limitation, lost profits, lost revenue, lost savings, loss of data,
replacement costs, or any similar damages, whether based in contract, tort
(including negligence), strict liability, or otherwise, arising from your use
of any of CHUDATS services or Heal Coins offers. However, because some regions
or jurisdictions do not allow the exclusion or limitation of liability for
consequential or incidental damages, in such regions or jurisdictions, our
liability shall be limited to the maximum extent permitted by law. All
challenges and worries encountered with Heal Coins usage should be forwarded to
issues@healcoins.net.
All users of our products and services are advised to
ascertain their knowledge about CHUDATS and its affiliates. We shall not be
liable for a user’s ignorance and/or error about the contact information of our
offices and further illegitimate transactions regarding Heal Coins and its
various online opportunities for users.
10.3
Representations
While using our Heal Coins site and offers,
you are solely responsible for your conduct and therefore agree to:
SECTION 11 –
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Heal
Coins, CHUDATS and our parent, subsidiaries, affiliates, partners, officers,
directors, agents, contractors, licensors, service providers, subcontractors,
suppliers, interns, and employees, harmless from any claim or demand, including
reasonable attorneys’ fees, made by any third-party due to or arising out of
your breach of these Terms and Conditions or the documents they incorporate by
reference, or your violation of any law or the rights of a third-party.
SECTION 12 – FINANCIAL /
DIGITAL MONETARY TRANSACTIONS
Processing Heal Coins transactions may, though
very rarely, come with some digital or online hassles based on network
connectivity issues. In case of any such hassles, including but not limited to
conversion rates and other inconsistencies with the Heal Coins, users should
forward their challenges or experiences to issues@healcash.net

.
Some of the Heal Coins monetary transactions are governed by certain
policies introduced on the CHUDATS.NET portal and include the following aspects
of this site:
12.1 Consultation Billing Policy –
Self-Booking of Appointments
We
permit the user to sign up or log in to our web portal and mobile application
after providing his or her identification or the requested information. After
logging in, you, the user, are granted categorical choices on different health
issues and health practitioners that are registered for e-consultation within
the “Heal the Sick” mobile app. The user's choice and availability of a physician
or health practitioner determine the billing model.
12.2 Consultation Billing Policy –
Consultancy Payments
Once
you have successfully booked an appointment with your chosen health expert, you
are directed to make payments in order to confirm your appointment with the
chosen health expert. Such payments are deducted from your heal cash wallet. In
case of emergencies where a health expert may become unavailable on the
appointment date, a new date is arranged and agreed upon between the concerned
parties. In extreme cases where the booked health expert may become totally
unavailable, the deducted HC from patient’s wallet is fully refunded. We have
instituted minimal charges for unduly rescheduling, and/or failing appointments
incurred by the defaulting party.
However,
total cancellation of the booking process will require a refund into the user’s
HCW, but a defaulting cancellation will still obtain a refund with penalty
deductions or charges.
12.3 Medical Report Updates
After a medical diagnosis, the patient's medical history will require an update. Such updates are saved as drafts across the medical process, but when they are finalised, a minimal charge will be imposed on the patient’s HCW before the update process is completed. However, such charges will apply to the concerned user health facility, HCW, when the patient has already been billed for an appointment booked and duly paid towards the concerned diagnosis process.
12.4 Settlement of Medical Bills
Heal
Coins through the HCW are the primary source of bill settlements within health
facilities that are subscribed to and using CHUDATS. The different operations
and charges, including but not limited to lap diagnosis, pharmacy medications
or drugs, staff advantages, and other patients’ medical bills incurred within
user health units, are settled with the HC.
Heal
Coins and Heal Notes are also introduced with extended usage privileges across
healthcare systems through our unique payment gateway that offers the
opportunity for settling healthcare bills accrued outside CHUDATS.
12.5 Billing Disputes
If
you, the user, believe we have charged your HCW in error, you must notify us or
our authorised payment processor in writing no later than 48 hours after you
receive the notice of charge deduction from your HCW account. You must submit
any such disputes, including all the digital transaction details, to the email
address: issues@healcoins.net.
Please include a detailed statement describing the nature and amount of the
disputed charges. We will investigate and correct any mistakes made that are
liable to our human services and add or credit them against your future payments
or refund the concerned HCW.
12.6 No Refund Policy
We
maintain a NO REFUND POLICY at
all levels of our system when it concerns the acquisition of Heal Coins into
HCWs and/or the purchase of Heal Notes for physical payments at subscribed user
structures and institutions. While using our system, you agree that once any
other source of currency is used to purchase or obtain HC into your HCW
accounts, you cannot withdraw or request a refund anymore. You shall only be
able to use HC for the purposes it is intended for, reserve it in your HCW as
an insurance mechanism for future uses, and/or transfer it to other HCWs.
While
maintaining the no refund policy from HC to any other currency, it is possible
to make refunds of HC usage into the HCW of the affected users. Such refunds
are guided by the appointments and consultation rules introduced within these Terms of Conditions and the User Agreement of CHUDATS.
For
the rule of exception, a refund in another currency can only be done under
exceptional circumstances approved or agreed upon by our sole discretion. If
you believe exceptional circumstances exist, please email us at issues@healcoins.net and
explain the circumstances that you believe merit such a refund. We are not
making any promise that we will give you a refund. If we give you a refund, we
will issue the refund in the form of free services or credit to the payment
method you used for your HC purchase. We will not make refunds in the form of
cash or checks. The provision of a refund in one instance does not entitle you
to a refund in the future for similar instances, nor does it obligate us to
provide refunds in the future under any circumstances.
The
general rule is NO REFUND. Heal Coins is a currency
for humanity that serves to save lives and objective causes and cannot be
subject to any form of illegal money laundering schemes that may deprive it of
its purpose and integrity.
12.7 Other Donation Opportunities
Heal Coins, as a currency for humanity, enjoys
the privilege of outstanding other monetary objectives in dedicating its
applicability and usability to serving the needy, affected, and most
unfortunate masses.
CHUDATS offers the opportunity of assisting the psychologically sick (promoting mental health) within society and support rehabilitation and social care initiatives such as orphanages, IDP centres, refugee camps, emergency crises, etc. These opportunities are harnessed through scrutinized assessments and case-by-case publications for donations on the CHUDATS.NET portal. Heal Coins can be used to make donations for such causes on the CHUDATS platform and ensure that the donors, through their dedicated HCW accounts, can have transparent and accountable follow-up and feedback or Donation Reports from such directly offered assistance.
SECTION 13 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or
provision of these Terms of Service shall not constitute a waiver of such right
or provision.
These Terms and Conditions and any policies or
operating rules posted by us on this site or with respect to CHUDATS constitute the entire agreement and understanding
between you and us and govern your use of our services, superseding any prior
or contemporaneous agreements, communications, and proposals, whether oral or
written, between you and us (including, but not limited to, any prior versions
of the Terms and Conditions).
Any ambiguities in the interpretation of these Terms and
Conditions shall not be construed against the drafting party.

We reserve the right, at our sole discretion, to

website periodically for changes. Your continued use of or access to healcoins.net
and CHUDATS products and services following the posting of any changes to these
Terms and Conditions constitutes acceptance of those changes.
